• <br />SUBJECT: Consideration of Amending Certain Sections of LDR Chapters 911 and <br />971 (Wireless Facilities Final Ordinance), and Approving the Indian River <br />County Wireless Facilities Master Plan <br />It is requested that the data herein presented be given formal consideration by the Board <br />of County Commissioners at its meeting of November 12, 2002. <br />BACKGROUND <br />On March 19, 2002, the Board of County Commissioners (Board) held its initial hearing <br />on an "interim ordinance' containing new regulations for wireless telecommunications <br />facilities. Subsequently, the Board, at a second hearing on April 2, 2002, adopted the <br />interim ordinance (Ordinance 2002-016) and terminated a moratorium that had been <br />placed on applications for new towers on new sites. That ` interim" ordinance is currently <br />in effect. <br />Since the interim ordinance was adopted, the county's wireless facilities consultant <br />(CityScape) and county staff have worked on development of a wireless facilities <br />inventory and master plan. In so doing, staff and Cityscape involved interested parties, <br />including wireless services providers, throughout the process of developing both the <br />master plan and the ordinance. <br />On August 13, 2002, the Board held a public workshop and reviewed a draft wireless <br />master plan. At that workshop, the Board directed staff to make various revisions, and <br />those revisions have been made. At its October 8, 2002 meeting, the Board reviewed the <br />revised master plan and indicated that it would adopt the plan in its final form. That plan <br />is now in final form and is attached <br />CityScape and staff have also developed a wireless facilities "final ordinance". The <br />proposed final ordinance was reviewed by the Professional Services Advisory Committee <br />(PSAC). At its September 19, 2002 meeting, the PSAC voted 6-0 to recommend that the <br />Board adopt the final ordinance (see attachment #2). The final ordinance was also <br />reviewed by the Planning and Zoning Commission which, at its October 10, 2002 <br />meeting, voted 6-0 to recommend that the Board adopt the ordinance with some minor <br />changes. Those changes have been incorporated into the proposed ordinance. The <br />ordinance, which includes adjustments and modifications to the regulations adopted in <br />April via the interim ordinance, is now ready for the Board's review and adoption. In <br />addition to and in conjunction with the ordinance, the wireless facilities master plan is <br />presented in final form for approval. <br />The Board is now to consider the proposed LDR amendment ordinance and is to approve, <br />approve with revisions, or deny the proposed ordinance, and is to act on the wireless <br />master plan. <br />AiNALYSIS <br />Proposed Ordinance <br />The "interim ordinance" adopted in April was comprehensive and detailed Those <br />regulations generally tightened requirements on wireless facilities (towers), and included <br />a prohibition on new non -stealth towers on new sites in residential and rural residential <br />areas.
