MT <br /> Commissioner Adams preferred to just use the Code Enforcement action , and <br /> Commissioner Macht noted that the applicant must be notified that he will be held liable . <br /> Director Boling commented that written acknowledgment of liability from the <br /> property owner is contained in the existing regulations . <br /> General discussion then took place regarding landscaping requirements , fencing , and <br /> the recent Nextel court case . <br /> Mr . Lepore noted that the District Court, in the Nextel case , found that the Board did <br /> not have the ability to reject the applicant ' s need to site and had issued no finding of fact . <br /> Chairman Ginn mentioned that she had seen a lot of towers recently in Philadelphia <br /> which were just about tree height and could hardly be noticed . <br /> Mr . Lepore believed that to be another type of technology and advised those were <br /> probably capacity sites . <br /> Chairman Ginn then opened the meeting to comments from the public . <br /> Gene Svatik, 350 Watercross Street , Sebastian , noted that the FCC had held back the <br /> commercial spectrum which will force more smaller towers and fewer larger towers . He <br /> wanted the Board to be aware that one large tower is less costly for the applicant that more <br /> smaller towers and that stealth towers are also cheaper . He stated that " smart " antennas will <br /> be coming out soon involving a focused beam through an aperture . He also noted that the <br /> FCC is considering adoption of Historic Preservation regulations . <br /> Chairman Ginn asked about Mr . Svatik ' s background, and he responded that he <br /> works for Harris Corporation designing commercial antennas for commercial cellular <br /> markets .
