The provision of the Agreement with John Lloyd that allowed for the extension of utilities is presented <br />below. <br />"The Developer is relying upon the construction of a sewer force main along High Street to be installed by <br />others (Smith Warehouse Development, Randy Mosby as Engineer -of -Record). Smith Warehouse is <br />currently under design and construction may not run concurrently with Woodmere Trade Center. <br />Therefore it is agreed that the DEI ELOPER install a 6 -inch sewer force main if the 6 -inch force main is <br />not installed along High Street under the Smith Warehouse Developer's Agreement or its sequel. If the <br />force main proposed by the Smith ff orehouse Developer's Agreement is not constructed, the DEI ELOPER <br />shall furnish and instal/ a 6 -inch PIC force main along the west side of High Street from CR -512 to :nil <br />Street. <br />The Work completed to date under the Jerry Smith Warehouse Developer's Agreement included survey, <br />design. and permitting through FDEP. Construction of utilities had NOT commenced and was delayed. <br />The Work completed under the Woodmere Trade Center Project include the onginal scope -of -work <br />outlined in the Woodmere Trade Center Developer s Agreement PLUS the additional utility work outlined in <br />the Jem• Smith Warehouse Developer's Agreement. <br />The amount of funds expended between both projects remain under budget and all work required by each <br />Agreement has been satisfied. <br />The staff of the Department of Utility Services recommends that the Board of County Commissioners <br />authorize the transfer of remaining funds from the Jerry Smith Warehouse Developer's Agreement to make <br />payment to John Lloyd for the actual work performed under the Woodmere Trade Center Developer's <br />Agreement.
