Environmental Planning <br /> & Code Enforcement <br /> FROM : Kelly Zedek <br /> Code Enforcement Officer <br /> DATE : 11 / 12/00 <br /> RE : RICHARD & MARTHA HABESHIAN REQUEST FOR RELEASE OF A <br /> PORTION OF AN EASEMENT AT 820 FOX TRAIL SW (LOT 16, FOX <br /> RIDGE SUBDIVISION) <br /> It is requested that the data herein presented be given formal consideration by the Board of County Commissioners <br /> at its regular meeting of November 21 . 2000. <br /> DESCRIPTION AND CONDITIONS <br /> The County has been petitioned by RICHARD & MARTHA HABESHIAN, owners of a lot at 820 Fox Trail SW, <br /> for release of a portion of a drainage and utility easement. The purpose of the easement release request is for the <br /> installation of a pool, pool deck, and fence in the rear twenty (20) foot drainage and utility easement ( see attached <br /> maps). <br /> ALTERNATIVES AND ANALYSIS <br /> The request has been reviewed by Bell South Communications. Florida Power & Light Corporation : T.C . I . Cable <br /> Corporation; the Indian River County Utilities Department: the County Road & Bridge and Engineering Divisions : <br /> the County surveyor and the Property Owners Assocation . None of the utility providers or reviewing agencies <br /> expressed an objection to the requested release of easement, provided that the pool and deck are located at least <br /> four feet from a sewerline that exists within the easement. Since the sewerline is in the portion of the easement that <br /> the County will retain, and the owners have agreed not to build the pool or deck closer than four feet to the <br /> sewerline, staff' s position is that the requested easement portion release would have no adverse impact to utilities <br /> being supplied to the subject properties or to other properties . If the release of easement is approved. the <br /> requirement of a four-foor setback from the sewerline will be specified in a release of easement approval letter that <br /> will be sent by staff to the owners. <br /> RECOMMENDATION <br /> Staff recommends that the Board, through adoption of the attached resolution, release a portion of the drainage <br /> and utility easement, as more particularly described in said resolution . <br /> November 21 , 2000 <br /> 29 <br /> BK 116 PG 187 <br />
