Concurrency: The applicant has committed to obtaining a final concurrency certificate prior <br />to issuance of each single-family building permit and has acknowledged all concurrency <br />requirements. Therefore, all concurrency requirements related to PD plan and special <br />exception use approval have been satisfied. <br />17. Caribbean Fruit Fly Host Plant: The County Comprehensive Plan requires that Caribbean <br />fruit fly host plants be prohibited within PDs located in general areas that have active citrus <br />groves. This project is located in such an area; therefore, the prohibition regulation applies. <br />The applicant has indicated that he has no objection to creating a restriction that would <br />prohibit host plants on the subject property. Such restriction must be included in the <br />project's covenants and restrictions which will be reviewed at the time of final plat <br />application. <br />18. Public B enefits: The benefits of the development are the proposed buffers, increased <br />perimeter setbacks increased conservation areas, increased minimum open space, common <br />recreational amenities, and pedestrian system. <br />RECO <br />ENDATION: <br />Based on the above analysis, staff recommends that the Board of County Commissioners grant PD <br />special exception use approval for "Abington Woods", with the following conditions: <br />1. That Caribbean fruit fly host plants are prohibited within the project area <br />2. That prior to the issuance of a land development permit, the developer shall: <br />a. Obtain release of a portion of the Murphy Act Easement as described in the <br />staff report, and <br />b. Obtain planning staff approval of detailed, final landscape plans for the <br />proposed buffers, common areas, and recreation/park tracts, and <br />3. That prior to or via the final plat, the developer shall: <br />a. Dedicate the depicted upland and wetland conservation easements, and <br />b. Install the depicted and approved perimeter buffer(s), and <br />c. Place a restriction on the property that prohibits the planting of Caribbean <br />fruit fly host plants. <br />4. The applicant will depict the non -released Murphy Act Easement area as right-of-way <br />on the final plat. <br />5.
