Further the Board <br />approved the conceptual PD plan and the rezoning to PD, with <br />the following conditions: 1) Prior to issuance of a certificate of <br />occupancy, the applicant must construct or bond out the <br />required 47`" Street sidewalk; and 2) Prior to issuance of a <br />certificate of occupancy, the applicant must construct or bond <br />out the required 28th Court sidewalk.) <br />ORDINANCE NO. 2002-028 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM <br />RM -10 TO PD FOR THE PROPERTY LOCATED ON THE SOUTHWEST <br />CORNER OF 28TH COURT AND 47TH STREET AND DESCRIBED HEREIN AND <br />PROVIDING FOR EFFECTIVE DATE <br />WHEREAS, on October 24, 2002, the Planning and Zoning Commission, sitting as the local <br />planning agency on such matters, held a public hearing and subsequently made a recommendation <br />regarding this rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners has determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County; and <br />WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian <br />River County, Florida, that the zoning of the following described property situated in Indian River <br />County, Florida to -wit: <br />LEGAL DESCRIPTION <br />Lot 1 of Martin Luther King Jr. Community Center Subdivision as recorded in Plat Book 16, <br />Page 98, Public Records of Indian River County, Florida <br />Be changed from RM -10, Residential Multi -Family (up to 10 units per acre) to PD (Planned <br />Development). <br />All with meaning and intent as set forth and described in said land development regulations, <br />and the attached approved conceptual PD plan and landscape plan. <br />The provisions of this ordinance shall become effective upon filing with the Department of <br />State. <br />November 5, 2002 <br />68 <br />• <br />• <br />
