<br /> SUBJECT .- Cemetery at 45th Street and 28th Avenue/Gifford Health Clinic
<br /> On January 4 , 1994 the Board of County Commissioners directed the County
<br /> Attorney' s Office to do whatever was necessary to claim the former cemetery
<br /> property in Gifford which was platted as the " Vero Beach — Burial Park' in 1926 .
<br /> The property had not been maintained for many years .
<br /> Pursuant to Florida Statute 497 . 345 , the County notified the State Department of
<br /> Banking and Finance of its intent to maintain the abandoned property. This
<br /> notice to the Department was acknowledged by the Department by a letter dated '
<br /> March 16 , 1994 . A public notice was published on January 17 , 1994 announcing
<br /> the County' s intent to maintain the abandoned cemetery and its further intention
<br /> to take possession of the property to the exclusion of all other persons . The
<br /> notice advised any person claiming a right to the property to notify the County in
<br /> writing . No one has come forward claiming any superior right.
<br /> Florida Statute 95 . 12 provides that " No action to recover real property or is
<br /> possession shall be maintained unless the person or the person ' s ancestor ,
<br /> predecessor, or grantor was seized or possessed of the property within seven
<br /> years before the commencement of the action ." The County having maintained
<br /> the property and been in possession of it for the requisite 7-year period , no claim
<br /> from a third party could prevail as to ownership at this point .
<br /> Recently I have had a number of discussions with Alan Polackwich , the attorney
<br /> for the Hospital District . He generally inquired as to whether the County would
<br /> approve the concept of leasing a portion of the former cemetery property to the
<br /> Hospital District for use as the Gifford Health Clinic .
<br /> Florida Statute 125 . 38 authorizes the County to either sell or lease to an agency
<br /> of the state or an organization not-for- profit organized for the purpose of
<br /> promoting the community interest and welfare for such price , whether nominal or
<br /> otherwise as the Board may fix . The statute requires an application to the
<br /> County for the sale or lease of the property and the passage of a resolution
<br /> which sets out the fact of the application , the purpose for which the property is to
<br /> be used , and the price or rent . These things can easily be accomplished .
<br /> Mr. Polackwich understandably has reservations about having the Hospital
<br /> District invest $ 1 . 5 million in a health clinic building when the County does not
<br /> have a deed to the property (" color of title" ) . If the Board of County
<br /> Commissioners is agreeable to the concept of selling a portion of the property to
<br /> the Hospital District for construction of a health clinic , there are a number of legal
<br /> alternatives available to obtain good title . The Hospital District has the power of
<br /> condemnation , but that would be a more expensive alternative to sale of the
