He knew of three other locations where Nextel might have located their tower <br />without a neighborhood's concern. He thought the Board should not allow this tower to be <br />installed. <br />Susan Temple, 1042 Near Ocean Drive, advised that she was present an behalfofthe <br />parents, teachers, and children who attend Maitland Farm Preschool to voice her concern <br />about the proposed Nextel tower. She advised of the key role that environment plays in the <br />children's learning experience because more than 50% of the children's time was spent <br />outside for nature walks, feeding animals, and finding fish in the pond. She felt the <br />construction of the tower would go against the mission of the school. She submi ed that <br />until enough data can be collected proving cellular towers are safe, the last thing n eded is <br />a health risk to the Maitland Farm community and the children. She believed if tre tower <br />is built, it would be intrusive, a possible liability, and a potential health hazard to the <br />children. She asked the Commissioners to consider how they would feel if the children were <br />theirs. She felt there must be another acceptable location where the tower would not affect <br />so many lives. The future is not cell phones and computers, it is our children. <br />Ken Hendricks, 6220 15` Street SW, has two children who att <br />end Maitland Farms. <br />He thought that the Board could see the cohesiveness of the neighborhood and what they do <br />when the pastoral setting is threatened. He questioned the appropriateness of the ordinance <br />that permits such a structure to be built and whether enough ground work was done when the <br />ordinance was enacted. He cited AT&T Wireless vs City of Virginia Beach where the 4" <br />Circuit of the United States Circuit Court <br />of Appeals ruled that the telecommunication <br />provision stating that "the state's regulation of wireless communications service shall not <br />prohibit or have an effect of prohibiting the provision of personal wireless service" applies <br />only to blanket prohibitions in general bans or policies, not to individual zoning decisions. <br />a7 Blt 1 l 6 PC 4� 7 <br />
