WHEREAS, it is necessary for Indian River County to expand the County's water system <br />to serve properties in the area of 28ih Court, SW, north of 5t° Street, and such expansion serves a <br />legitimate public purpose; and <br />WHEREAS, in connection with the expansion of the County's water system, it is <br />necessary for the County to formally accept an easement for utility purposes only, on 28' Court, <br />SW, north of 5' Street (a/k/a Rebel Road), shown as 28" Court on the Westwood Subdivision <br />plat recorded in Plat Book 9, Page 66, of the public records of Indian River County, Florida, <br />together with the other utility easements depicted on such plat for utility purposes only, <br />consistent with the Certificate of Dedication set forth on such plat, <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that the Board of County <br />Commissioners hereby formally accepts an easement for utility purposes only, on 28" Court SW, <br />north of 5' Street SW (a/k/a Rebel Road), shown as 28th Court on the Westwood Subdivision plat <br />recorded in Plat Book 9, Page 66, of the public records of Indian River County, Florida, together <br />with the other utility easements depicted on such plat for utility purposes only, in Indian River <br />County, Florida, as shown on EXHIBIT "A", attached hereto. <br />The resolution was moved for adoption by Commissioner Ginn ,and <br />the motion was seconded by Commissioner Stanbridge , and, upon being put to a <br />vote, the vote was as follows: <br />Chairman Fran B. Adams Ave <br />Vice Chairman Caroline D. Ginn Ave <br />Commissioner John W. Tippin Aya <br />Commissioner Kenneth R.
