DESCRIPTION AND CONDITIONS <br />The developer cf Waterford Lakes Subdivision, located south of 12th <br />Street just east of Vero Beach Elementary School, has recently <br />culverted the 12th Street Indian River Farms Water Control District <br />Canal along 11325 L.F. of 12th Street frontage. The County cost <br />shared in this piping via a Developer's Agreement (County share was <br />$32,500 or approximately 1/3 the cost.) The developer has also <br />widened and resurfaced 12th Street. <br />Due to the close proximity of the Vero Beach Elementary School, and <br />the large potential for numerous children residing in Waterford <br />Lakes to attend Vero Beach Elementary School, the Public Works <br />staff has requested the developer to design and construct a 5' side <br />sidewalk along the 12th Street frontage. Construct -ion at this time <br />will save costs for sod removal, regrading, and mobilization. The <br />cost for 1,325 l.f. is $14,906.25. The attached Amendment #1 to <br />the September 18, 2001 developer's agreement provides for County <br />funding since the Developer was not required to build a sidewalk <br />due to the presence of the canal. <br />ALTERNATIVES AND ANALYSIS <br />The following alternatives are recommended: <br />Alternative No. 1 <br />Approve Amendment <br />Alternative No. 2 <br />Deny approval. <br />No. 1 to the Developer's Agreement. <br />RECOMMENDATIONS AND FUNDING <br />Staff recommends Alternative No. 1. Funding in the amount of <br />$14,906.25 to be from It Local Option Sales Tax, Acct. 315-214-541- <br />066.32 ($74,330 available for Sidewalks). <br />ON MOTION by Commissioner Adams, <br />SECONDED by Commissioner Tippin, the Board <br />unanimously approved Amendment No. 1 to the <br />Developer's Agreement with Waterford Lakes of <br />Indian River County, Inc., as recommended by staff. <br />AMENDMENT IS ON FILE IN THE <br />OFFICE OF THE CLERK TO THE BOARD <br />DECEMBER 18, 2001 <br />-94- <br />
