He felt this is a unique situation because this <br />is a very small cove. Mr. O'Haire's land only connects to the cove by a 7 -foot strip of land. <br />He gave some further background on the issues involved, noting that Mr. O'Haire had filed <br />a "unity of title" action on his parcel after further division of the parcel by Michael O'Haire, <br />Mr. O'Haire's father. Mr. Collins' dock was built in 1977 and, since no resolution could <br />be reached, he has asked the circuit court to make the decision. He also noted that staff had <br />been prepared to issue a dock permit to Mr. O'Haire using the west side of the dock to moor <br />his boat which would be a big help to him. <br />Rod Reed, 2205 14" Avenue, President of Masteller & Moler, pointed out the <br />differing riparian lines to the Board. <br />Commissioner Macht commented that this is a very complicated issue and he felt that <br />if the permit is not issued until the circuit court case is finalized, there would be no harm to <br />anyone. <br />DECEMBER 18, 2001 <br />-83- bk ?.?
