11.G.2. 43RD AVENUE WIDENING AND DRAINAGE <br />IMPROVEMENTS - PROJECT #9601 - DEVELOPER'S <br />AGREEMENT WITH CAROLINA TRACE, LLC <br />The Board reviewed a Memorandum of November 19, 2001: <br />TO: James Chandler <br />County Administrator <br />THROUGH: James W. ( �J <br />Protect Engineer <br />SUBJECT: 43rd Avenue Widening and Drainage Improvements <br />Project # 9601 <br />Developer's Agreement with Carolina Trace, L.L.C. <br />DATE: November 19, 2001 <br />The Carolina Trace, L.L.C. is constructing a new facility on 43`d Avenue at 16`" Street. <br />They have designed their stormwater management pond to accommodate runoff from <br />their site and a portion of 43`d Avenue. The attached Agreement details the assignment <br />of costs and responsibilities necessary for both the County and Carolina Trace to benefit <br />from the joint use of this pond. <br />The County is to pay a total of $135,000.00 for the County's share of the land value and <br />construction costs of the pond, perpetual maintenance, a sum for lost profits, and for new <br />right-of-way on 16`" Street. The cost to the County is approximately the same as it would <br />otherwise cost to purchase a parcel of land and construct a pond separately for the <br />planned improvements to the roadway. The key benefits to sharing Carolina Trace's <br />pond is that the pond is an aesthetic feature of their site development and will be <br />maintained by them in perpetuity. Additionally, we will not have to remove another parcel <br />of otherwise developable land from private ownership. <br />Staff recommends that the Board approve the attached Developer's Agreement for a total <br />cost of $135,000.00 and authorize the Chairman to sign the Agreement. <br />DECEMBER 4, 2001 <br />-107- <br />
