i <br /> I <br /> Future Land Use Element Policies 1 .6 and 1 .41 <br /> Future Land Use Element Policy 1 .6 limits the C- 1 land use designation to publicly owned land with <br /> conservation and/or limited passive recreational uses. Since the Con- 1 zoning district is also limited <br /> to publicly owned land with conservation and/or limited passive recreational uses, the Con- 1 zoning <br /> district is consistent with, and allowed on, C4 designated land. In fact, Future Land Use Element <br /> Policy 1 .41 specifically establishes that G1 designated land can only be zoned Con- 1 . <br /> To ensure that the subject properties are not rezoned to Con4 until the land use amendment <br /> redesignating the subject properties to C4 is in effect, the rezoning ordinance contains a special <br /> provision. That provision establishes that the rezoning ordinance cannot become effective until the <br /> sites have been redesignated to C- 1 . For these reasons, the request is consistent with Future Land <br /> Use Element Policies 1 .6 and 1 .41 . <br /> As part of the staff analysis, all policies in the comprehensive plan were considered. Based upon <br /> that analysis, staff determined that the proposed rezoning is consistent with the comprehensive plan. <br /> Potential Impact on FnAronmental Quality <br /> The sites ' existing zoning districts offer only limited environmental protections. Development of <br /> residentially zoned land would be required to preserve only 10 or 15 percent of the upland habitat <br /> of the sites. Being exempt from the upland preservation requirement, agricultural development of <br /> agriculturally zoned land could result in the removal of all upland habitat on site. In contrast, under <br /> the proposed zoning district, the entire area of each site will be preserved, and development will be <br /> limited to conservation and compatible passive recreational uses. <br /> Although the sites are publicly owned and could be developed as public parks under the existing <br /> zoning districts, the proposed zoning district provides the sites with additional protection from <br /> development. By prohibiting most types of development on the sites, the proposed request will <br /> ensure that the environmental quality of the sites will be preserved. <br /> For these reasons, the proposed rezoning is anticipated to positively impact the environmental <br /> quality of the subject properties . <br /> CONCLUSION <br /> Based on the analysis, staff has determined that the proposed rezoning is consistent with the <br /> comprehensive plan, compatible with all surrounding land uses, and will cause no adverse impacts <br /> on the provision of public services. The proposed changes will ensure the preservation of <br /> environmentally sensitive and important habitat. For these reasons, staff supports the request. <br /> 12F.
