RECOMMENDATION <br />Staff recommends that the Board, through adoption of the attached resolution, release the drainage <br />and utility easement, as more particularly described in said resolution. <br />ATTACHMENTS <br />1. County Resolution 99-119 <br />ON MOTION by Commissioner Macht, SECONDED BY <br />Commissioner Adams, the Board unanimously (4-0, Chairman <br />Stanbridge absent) adopted Resolution No. 2002-011 releasing <br />a portion of an Easement retained over an abandoned portion of <br />18th Avenue right-of-way in W. E Geoffrey Subdivision. <br />RESOLUTION NO. 2002 - 011 <br />A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA, RELEASING <br />A PORTION OF AN EASEMENT RETAINED OVER AN ABANDONED <br />PORTION OF 1STH AVENUE RIGHT-OF-WAY IN W.E. GEOFFREY <br />SUBDIVISION <br />WHEREAS, Indian River County has an interest in a drainage and utility easement retained <br />on an abandoned road right-of-way in W E Geoffrey Subdivision; and <br />WHEREAS, the retention of a portion of the easement, as described below, serves no public <br />purpose; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Indian <br />River County, Florida that: <br />This release of easement is executed by Indian River County, a political subdivision of the State <br />of Florida, whose :nailing address is 1840 25th Street, Vero Beach, Florida 32960, Grantor, to <br />HCD PROPERTIES LLC <br />3790 7TH TERRACE, STE 202 <br />VERO BEACH, FL 32960 <br />its successors in interest, heirs and assigns, as Grantee, as follows: <br />Indian River County does hereby release and abandon all right, title, and interest that it may <br />have in the following described easement(s): <br />the east fifteen feet of the forty foot wide drainage and utility easement retained over an <br />abandoned portion of 18th Avenue right-of-way as depicted on the plat of W E. Geoffrey <br />Subdivision, PBS 2-32, in accordance with the right-of-way abandonment per County Resolution <br />99-119, recorded in OR.
