Planning Director Stan Boling explained that this is a private road with an oversized <br />72 -foot right-of-way. The standard right-of-way is 68 feet. The County will retain a 6 -foot <br />drainage and utility easement. <br />The Chairman opened the public hearing and asked if anyone wished to be heard <br />regarding this matter. There being none, the Chairman closed the public hearing. <br />ON MOTION by Commissioner Adams, <br />SECONDED by Commissioner Ginn, the Board <br />unanimously adopted Resolution 2002-013 <br />providing for the closing, abandonment, vacation <br />and discontinuance of a 6' wide portion of Via <br />Marbella Boulevard within the Grand Harbor <br />Development and reserving the entire right-of-way <br />as a drainage and utility easement. <br />RESOLUTION 2002-013 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA, PROVIDING FOR THE CLOSING, <br />ABANDONMENT, VACATION AND DISCONTINUANCE OF A 6' WIDE <br />PORTION OF VIA MARBELLA BOULEVARD WITHIN THE GRAND <br />HARBOR DEVELOPMENT AND RESERVING THE ENTIRE RIGHT-OF-WAY <br />AS A DRAINAGE AND UTILITY EASEMENT, SAIDA LAND LYING IN INDIAN <br />RIVER COUNTY, FLORIDA <br />WHEREAS, on July 25, 2001, Indian River County received a duly executed and <br />documented petition from GHA Grand Harbor, Ltd. of Florida, requesting that the County close, <br />vacate, abandon, discontinue renounce and disclaim any right, title and interest of the County and <br />the public in and to a portion 6' wide section of Via Marbella Boulevard as shown on the plat of the <br />River Club subdivision, and recorded in Plat Book 12, Page 64-64E of the public records of Indian <br />River County Florida , said lands lying to Indian River County, Florida; and <br />WHEREAS, in accordance with Florida Statutes 336.10, notice of a public hearing to <br />consider said petition was duly published; and <br />FEBRUARY 19, 2002 <br />
