Deputy County Attorney William G. Collins II reviewed his memorandum and his <br />recommendation for the Board to authorize the Chairman to execute the County Deeds and <br />Acknowledgment and Stipulation, as presented in the backup. <br />Deputy Attorney Collins advised there were additional documents desired by the <br />attorneys for Lost Tree Village Corporation. He summarized the details of the documents <br />which included a Post Closing Agreement, indemnifications from the Town of Indian River <br />Shores and City of Vero Beach, Internal Revenue Service forms, an Assignment and <br />Assumption of Responsibilities concerning Joe Earman Park, and a Quit ClK im Deed for a <br />small triangular portion of McCullers Point to clear up any interest Lost Tree might have. <br />He recommended the Board authorize the Chairman to sign the documents he had described <br />which will be necessary to close the transaction. <br />Deputy Attorney Collins further advised that the State is entering into agreements to <br />dismiss all appeals and Lost Tree will release the State from any liability n this matter. <br />There are also releases required from St. Johns River Water Management District. <br />Deputy Attorney Collins also advised that the closing was tentatively Scheduled for <br />8:30 a.m. the next day (February S) but there were some timing requirements that might not <br />be able to be met regarding delivery of original documents and receipt of the funds. The <br />next possible date to get all the parties together would be February 12'. He eras hoping to <br />negotiate with Lost Tree to allow the closing the next morning and he would keep the <br />Commissioners posted. (Clerk's Note: The closing did take place on the morning of <br />February 5, 2003 followed by a celcbratory reception in the County Administration <br />Building.) <br />February 4, 2003 <br />
