Collins II — Deputy County Attorney <br />January 31, 2002 <br />SUBJECT: Confidentiality of Appraisals of The Lost Tree Village Islands <br />The County is at the stage of its negotiations with the Florida Communities Trust <br />at which the County must elect whether to pursue a joint acquisition of the <br />islands with the Florida Communities Trust or to pre -acquire the islands and <br />subsequently seek reimbursement for the Florida Communities Trust share of the <br />purchase price. <br />Under the joint acquisition process, there are a number of requirements set out in <br />the Florida Administrative Code governing the procedures which the Florida <br />Communities Trust must utilize. It is standard FCT procedure to enter into an <br />o ption agreement for sale and purchase, which option agreement is contingent <br />o n appraisals supporting the purchase price, etc. The Lost Tree Village <br />Corporation has indicated that they may not entertain an option agreement but is <br />looking for a binding contract. Appraisals are required to be kept confidential <br />u nder the FCT joint acquisition process <br />Should the local governments pre -acquire the property and seek reimbursement <br />from FCT, we have been advised by Caroline Sutton of the FCT appraisal staff <br />that the confidentiality requirements are only those that the County chooses to <br />impose on itself. Currently the Land Acquisition Guide calls for all appraisals, <br />offers and counter offers to be confidential and exempt from the public records <br />law until an option contract is executed, or if no option contract is executed, until <br />30 days before a purchase agreement is considered for approval by the Board <br />FEBRUARY 5, 2002 <br />-59- <br />B" 1> <br />A <br />;.0 3v'J_es <br />eeee <br />• <br />
