Commissioner Macht questioned whether or not it would be critical for the sewer and <br />water to be installed, and Community Development Director Bob Keating stated that water <br />would be required by the fire department for safety reasons. <br />Mr. Kirrie continued that condition #2 regarding connection to the County water and <br />sewer system would be ok. He also agreed to condition #3 regarding the fencing. He did <br />not believe that condition #4 regarding the consultants would be a mayor item but he was led <br />to believe that any modifications had to be done by the City and the County. <br />Environmental Chief Roland DeBlois noted that the issue is the payment for analysis <br />and justification which must be done by a professional consultant. <br />Commissioner Macht then questioned Mr. Kirrie about condition I15 regarding <br />wetland or upland mitigation, and Mr. Kirrie stated that would be handled by his engineer <br />when the road is constructed. <br />Mr. Kirrie continued that condition #6 would be addressed as a site plan issue <br />through the City of Sebastian. <br />Commissioner Macht emphasized that, should the Board vote favorably, everything <br />would be conditioned on all these conditions being met or there would be a reverter which <br />would take effect. <br />County Attorney Paul Bangel agreed that a contract could be constructed in such a <br />way to include those conditions. He noted for the Board that, if a 60 -foot strip were <br />conveyed by quit claim deed, the County would only acquire whatever interest in the <br />property Mr. Kirrie might have at that time. <br />Commissioner Adams questioned whether Mr. Kirrie could obtain clear title to the <br />property, and Mr Kirrie replied that would involve a quiet title action. <br />Mr. DeBlois noted that Florida Communities Trust and Fish & Wildlife will <br />absolutely require clear title if any real property is swapped. <br />Chairman Stanbridge noted that the Management Plan for the conservation lands <br />would also have to be redone. <br />FEBRUARY 5, 2002 <br />�r <br />-72- <br />
