Knight <br />DATE: March 12, 2002 <br />DESCRIPTION AND CONDITIQN5 <br />Additional right-of-way is needed along the west side of 58`h Avenue, south of Oslo Road, <br />to facilitate the 58`h Avenue, Phase II Improvements. The proposed right-of-way measures <br />76.0 feet x 915.00 feet, and contains a total area of 1 596 acre. <br />The Sellers have executed a Contract for Sale and Purchase in the amount of $28,735.00 <br />which is based on $18,000.00 per acre. This price -per -acre is typical of other recent right- <br />of-way purchases the County has made, and is in line with the market for the area. <br />In addition to the right-of-way cost, the County will have to relocate a flow well by elbowing <br />and restubbing it at a cost of approximately $1,500.00, and relocate a pasture fence at a <br />cost of approximately $4,955 00. The County will also have to pay attorneys fees of <br />$2,373.50 to Michael O'Haire; therefore, the total cost of this transaction is $37,563.50 <br />There are no appraisal fees. <br />RECO1v1ME_LJDATIONS AND FUNDING <br />Staff recommends the Board of County Commissioners approve the $28,735.00 land <br />purchase plus $2,373.50 attorney fees, and approximate cost of $1,500.00 for the well <br />relocation, and $4,955 cost of relocating the fence, for a total expenditure of $37,56150 <br />and authorize the Chairman to execute the contract. <br />Funding to be from Account #315-214-541-066.12 <br />ATTACHMENT <br />1) Contract for Sale and Purchase <br />March 19, 2002 <br />99 <br />
