• • <br />At its February 20, 2001 meeting, the Board agreed to reconsider the condition and a P.D. plan <br />modification at a public hearing. The applicant has now submitted a revised P.D. plan along with <br />a request to modify the original recreation tract condition and staff has scheduled this public hearing <br />for this matter. The hearing has been properly noticed and advertised at the applicant's expense. <br />Therefore. the Board is now to consider the proposed P D plan modification and a modification to <br />the original approval condition relating to recreation tract area. <br />ANALYSIS: <br />The P.D. ordinance (Chapter 915) sets forth recreation area requirements that correspond to the <br />number of proposed residential units. Under Chapter 915 standards pedestrian paths. recreation <br />areas, playgrounds, playfields. and active recreation facilities like tennis courts may all count toward <br />meeting the P. D. recreation area requirement. For the Legend Lakes project. 1.97 acres of recreation <br />area is required Under the January 91" ("old plan') 2.8 acres of recreation area (including 3 <br />recreation tracts totaling 2.2 acres) was provided. The revised P.D. plan adds one lot to the <br />southeastern recreation tract resulting in a total recreation area of 3.1 acres (includes 3 recreation <br />tracts totaling 2.5 acres. On the expanded tract. the revised P D plan proposes two tennis courts, <br />a small parking area. and a grassed playfield/playground area. By expanding the tract by one lot. the <br />total number of lots within the project is reduced from 164 to 163 lots. <br />The proposed changes are summarized as follows: <br />January 9th/ "Old" Plan Revised Plan <br />164 lots <br />2.08 units/acre <br />2.8 acres recreation area <br />163 lots <br />2.06 units/acre <br />3.1 acres recreation area <br />Staff has reviewed the proposed changes and supports approval of the revised P.D. plan with all <br />originally recommended approval conditions together with a new condition that requires 3.1 acres <br />of total recreation area as shown on the revised P.D. plan. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners approve the revised P.D. plan for the <br />Legend Lakes project, with the following conditions: <br />1. That 3.1 acres of recreation area be provided as shown on the revised P.D. plan. <br />2. Caribbean fruit fly host plants are prohibited within the project area. <br />3. That prior to issuance of a land development permit, the applicant shall obtain from <br />planning staff approval of detailed. final landscape plans for the required buffers. <br />entry landscape areas. and recreation areas. <br />a. The Oslo Road buffer shall meet or exceed the standards for a Type "B" <br />buffer with 6' opaque feature and shall not include the use of a wooden fence. <br />and <br />March 20, 2001 <br />b.
