Environmental Planning <br />& Code Enforcement <br />FROM: Kelly Zedek <br />Code Enforcement Officer <br />DATE: 3/12/01 <br />RE: MARATHON ASHLAND PETROLEUM REQUEST FOR RELEASE OF <br />EASEMENT AT 9009 20TH STREET <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissione-rs at its regular meeting of March 20, 2001. <br />DESCRIPTION AND CONDITIONS <br />The County has been petitioned by Marathon Ashland Petroleum. owner of a parcel at 9009 20th <br />Street. for release of a twenty foot wide drainage and utility easement. The purpose of the easement <br />release request is to allow for the construction of a stormwater pond and an access road between <br />the subject commercial property and a neighboring business (see attached map). <br />ALTERNATIVES AND ANALYSIS <br />The request has been reviewed by Bell South Communications. Florida Power & Light Corporation: <br />T C.I. Cable Corporation; the Indian River County Utilities Department: the County Road & Bridge <br />and Engineering Divisions; and the County surveyor. None of the utility. providers or reviewing <br />agencies expressed an objection to the requested release of easement. Therefore. it is staff s <br />position that the requested easement release would have no adverse impact to utilities being <br />supplied to the subject properties or to other properties. <br />RECOMMENDATION <br />Staff recommends that the Board. through adoption of the attached resolution. release the drainage <br />and utility easement, as more particularly described in said resolution. <br />ATTACHMENTS <br />Proposed County Resolution Abandoning Easement <br />Map depicting easement proposed for release <br />March 20, 2001 <br />G 4 9 <br />26 <br />
