Russ, C.B.O. <br />Building Official <br />DATE:Tuesday, February 26, 2002 <br />SUBJECT: Request to amend Indian River County Code Chapter 401, Building <br />Codes, to adopt the Florida building Code. <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular meeting <br />of March 5, 2002. <br />BACKGROUND: <br />For years, the county, through its code of laws and ordinances, has adopted <br />the building and mechanical codes based on the Southern Building Code <br />Congress International Standard Building Code Series. With the passage of <br />Florida Statute 553.70, the "Florida Building Codes Act", the State has <br />mandated the uniform adoption, updating, amendment, interpretation, and <br />enforcement of a single, unified state building code, to be called the <br />Florida Building Code for the design, construction, erection, alteration, <br />modification, repair, or demolition of public or private buildings. As <br />structured, the proposed amendments to the County Code Chapter 401 will <br />constitute adoption by the county of the Florida Building Code. A copy of <br />the Florida Building Code is on file in the Board of County Commissioners <br />office for reference. <br />ANALYSIS: <br />The Florida Building Code, as published by the Florida Building Commission, <br />provides all of the necessary technical codes previously included in the <br />county's Ordinance as Standard Codes. Subject to the provisions of the <br />Florida Building Codes Act, responsibility for enforcement, inteLpretation, <br />and regulation of the Florida Building Code shall be vested in the local <br />government. According to state law, all entities authorized to enforce the <br />Florida Building Code pursuant to s. 553.80 shall comply with the <br />applicable standards for issuance of certificates of occupancy, minimum <br />types of inspections, and procedures for plans review and inspections as <br />established by the Florida Building Commission by rule. While a major <br />purpose of the Florida Building Code is to provide statewide uniformity, <br />local governments may adopt amendments to the administrative provisions of <br />the Florida Building Code if: a.)
