• <br />Developer's Share <br />County's Share <br />Total Project Cost <br />$59,452.90 <br />$446,932.10 <br />$506,385.00 <br />As homes are built in the project, homeowner's will pay a total of $2,646,016.00 in water and sewer <br />capacity charges. The developer has agreed to pay $458,544.00 to reserve 164 sewer equivalent <br />residential units.(ERU) prior to the County's reimbursement of funds described in the developer's <br />agreement. Construction of the force main will allow the County to coordinate expansion of the <br />wastewater collection system with development of the site, as well as provide sewer service to future <br />development along the improved corridor. The County's total share of $458,544.00 will be funded <br />from the capacity charge fund. <br />RECOMMENDATION <br />The staff of the Department of Utility Services recommends that the Board of County Commissioners <br />approve the attached developer's agreement as presented, and authorize the Chairman to execute the <br />same. <br />MCH/mch <br />Attachments <br />Commissioner Adams questioned staff concerning this agreement and was not <br />comfortable with approving it because she wanted more information about River Bend 296 <br />LLC She felt there are a lot of groups were involved and asked about foreign limited <br />liability and Shopco. <br />Utility Services Director Donald R. Hubbs advised that the County Attorney's office <br />did their usual corporate research and found that United Corporate Services of Miami, <br />Florida is the registered agent. <br />Deputy County Attorney Will Collins advised that a foreign limited liability is a <br />limited liability company organized in some other state than Florida. It is required they have <br />a resident agent in Florida. He further advised the structure of a limited liability company in <br />that they do not have a president but act through their members. <br />Director Hubbs advised there was some initial confusion as to the owner and they had <br />to go back and forth a couple of times to get the name. <br />Commissioner Adams was very uncomfortable with this. <br />March 6, 2001 <br />123 <br />BK I i i PG 02 <br />• <br />
