AICP <br />Chief, Environmental Planning <br />& Code Enforcement <br />FROM: Kelly Zedek <br />Code Enforcement Officer <br />DATE: 02/13/01 <br />RE <br />• <br />REX & NANCY KEISER REQUEST FOR RELEASE OF EASEMENT AT <br />3425 65TH AVENUE (LOT 34, OAK CHASE SUBDIVISION PHASE I) <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its regular meeting of March 6, 2001. <br />DESCRIPTION AND CONDITIONS <br />The County has been petitioned by Nancy and Rex Keiser. owners of a lot at 3425 65th Avenue. <br />for release of a five foot portion of a fifteen foot drainage and utility easement. The purpose of the <br />easement release request is for the construction of a pool and deck five feet into the fifteen (15) <br />foot utility and drainage easement (see attached map). <br />ALTERNATIVES AND ANALYSIS <br />The request has been reviewed by Bell South Communications: Florida Power & Light Corporation: <br />T C.I. Cable Corporation: the Indian River County Utilities Department: the County Road & Bridge <br />and Engineering Divisions: and the County surveyor. None of the utility providers or reviewing <br />agencies expressed an objection to the requested release of easement. Therefore. it is staff s <br />position that the requested easement release would have no adverse impact to utilities being <br />supplied to the subject properties or to other properties. <br />RECOMMENDATION <br />Staff recommends that the Board. through adoption of the attached resolution. release the drainage <br />and utility easement, as more particularly described in said resolution. <br />March 6, 2001 <br />43 <br />BR <br />Pb 1'302 <br />• <br />
