Collins II — Deputy County Attorney <br />DATE: April 3, 2001 <br />SUBJECT: Humane Society Property Purchase <br />and Lease -Back <br />At its February 13th meeting the Board of County Commissioners agreed to <br />purchase and lease back the existing Humane Society facility until such time as a <br />new home for the Humane Society was constructed. <br />Presented today for your consideration is a resolution approving a lease of the <br />property to the Humane Society for a term of five years or until 90 days after they <br />are issued a Certificate of Occupancy for their new facility, whichever occurs first. <br />Also presented is a Contract for the Sale and Purchase of Real Property and <br />Related Matters, as well as a Lease for the existing facility. The County will be <br />paying the Humane Society $380,000 as well as committing $20,000 to future <br />paving of 77th Street and provide compensation to the Humane Society for 13 <br />ERUs of sewer capacity and three ERUs of water capacity. <br />Recommendation: <br />Approve the attached resolution authorizing the Lease; authorize the Chairman <br />to execute the Contract for the Sale and Purchase of Real Property and Related <br />Matters; authorize the Chairman to execute the Lease -Back of the existing facility <br />to the Humane Society. <br />Deputy County Attorney Will Collins noted that the lease does not include the <br />required language regarding liability insurance. He has spoken with Attorney McDonough <br />of the Humane Society and they have agreed to add that language to the lease, <br />APRIL 10, 2001 <br />-77- <br />BK 1 17 PG 872 <br />
