P= Permitted <br />A= Administrative permit <br />S= Special exception <br />'The requirements of section 917.06(11), of the Accessory Uses and Structures Chapter, <br />shall apply to towers. <br />2For wireless commercial facilities regulations see section 971.44(5). <br />The introduction portion of Section 971.44(1) is hereby amended to read as <br />follows: <br />Non -wireless Ecommercial communications towers seventy (70) feet or more in <br />height (administrative permit and special exception). NOTE: Wireless facilities <br />are regulated under section 971.44(S) <br />L. LDR subsection 971.44(5) is hereby created, to read as follows: <br />"(5) Wireless commercial communications facilities (staff -level approval, administrative <br />permit, and special exception) <br />Sec. 1 Purpose and Intent and Siting Alternatives Hierarchy. <br />The purpose and intent of these regulations are to: <br />(a) Promote the health safety and general welfare of the public by regulating the <br />siting of wireless communication facilities, including satellite earth stations; <br />and <br />(b) Minimize the impacts of wireless communication facilities on surrounding <br />areas by establishing standards for location, structural integrity and <br />compatibility: and <br />(c) Encourage the location and collocation of wireless communication equipment <br />on existing structures thereby minimizing new visual, aesthetic and public <br />safety impacts, effects upon the natural environment and wildlife, and to <br />reduce the need for additional antenna -supporting structures. and <br />(d) Accommodate the _growing need and demand for wireless communication <br />services; and <br />(e) Encourage coordination between suppliers of wireless communication services <br />in Indian River County; and <br />(0 Respond to the policies embodied in the Telecommunications Act of 1996 in <br />such a manner as not to unreasonably discriminate between providers of <br />functionally equivalent personal wireless service or to prohibit or have the <br />effect of prohibiting personal wireless service in the County, and <br />Ig) Establish predictable and balanced regulations governing the construction and <br />location of wireless communications facilities, within the confines of <br />permissible local regulation, and <br />APRIL 2, 2002 <br />
