i <br />SUBJECT: Appeals by Steve and Linda Brown and the North Beach Civic Association of <br />a Planning and Zoning Commission Decision to Approve a Major Site Plan for <br />a 7 Unit Building for the Atlas Development Company <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its regular meeting of April 3, 2001. <br />DESCRIPTION & CONDITIONS <br />Steve and Linda Brown and the North Beach Civic Association have each filed separate appeals of <br />a decision by the Planning and Zoning Commission to approve a site plan for a proposed seven -unit <br />condominium building on a north barrier island oceanfront site. At its February 22, 2001 meeting, <br />the Planning and Zoning Commission voted 6 to 1 to approve the project with conditions. The two <br />appeals have been consolidated under a single item in an effort to provide a more efficient means <br />of Board of County Commissioners' consideration. For reference, please refer to the staff report and <br />minutes from the February 22, 2001 Planning and Zoning Commission Meeting (See attachment <br />#2). <br />According to the county's land development regulations (LDRs), appeals of decisions of the <br />Planning and Zoning Commission are considered by the Board of County Commissioners. The <br />Board is authorized to review the Planning and Zoning Commission's decision and approve, approve <br />with conditions, or deny the subject site plan application. <br />The site plan application now under appeal was submitted by Knight, McGuire & Associates, Inc. <br />on behalf of Atlas Development Corp. This application reflects the applicant's proposal to develop <br />a 7 unit condominium building. Located between SR A -1-A and the Atlantic Ocean, the 1.83 acre <br />subject property is just north of the Summer Place subdivision, and is zoned multi -family (RM -4). <br />The homes located south of the subject site in Summer Place were built in the 1970's and are located <br />seaward of the 1987 Coastal Construction Control Line (CCCL) and in some cases up to and <br />partially seaward of the 1981 CCCL. North of the subject site, there is a more recently constructed <br />home that is located just landward of the 1987 CCCL. That home is owned by appellants Steve and <br />Linda Brown. <br />The Atlas Development Company is proposing a single three story building containing 7 units with <br />a separate pool. The entire building and approximately one-half of the pool area are to be located <br />landward of the 1987 CCCL with the remaining portion of the pool area located east of the 1987 <br />CCCL. As proposed, the Atlas Development project will have a single driveway connection to SR <br />A -1-A to provide access to the 7 units. As required by the county's land development regulations, <br />the site plan depicts a landscaped Type "D"double frontage buffer along the south property line <br />(Sandalwood Lane). <br />t <br />Over the past year and a half, several site plan designs for the site have been proposed and submitted. <br />The first project was known as the Boston Homes/Orchid Dune project, and proposed two units and <br />two guest cottages with building area located seaward of the 1987 CCCL. That project was approved <br />by the Board of County Commissioners and then appealed to court by surrounding property owners. <br />The court overturned the Board's approval on procedural grounds. <br />A second proposal was later submitted to construct a 7 -unit condominium building. <br />was similar to the resent one, o That site plan <br />p but proposed locating the condominium building partially seaward <br />of the 1987 CCCL.
