Chandler, County Administrator <br />i <br />THRU: Joseph A. Baird, Assistant County Administrator <br />FROM: Beth Jordan, Risk Manager <br />DATE: May 1, 2002 <br />SUBJECT: Consent Agenda; Settlement; Henry Beidler; State of Florida Division of <br />Administrative Hearings, Office of the Judge of Compensation Claims, District I -North," Indian <br />River County, OJCC No. 98-020586PSL; 01-006231 PSL <br />Staff requests the following be considered on the May 14, 2002, consent agenda. <br />Staff recommends that the Board approve a settlement with Henry Beidler, a Sheriffs Office <br />employee, that was reached tentatively at mediation, to pay the amount of $75,000.00 <br />including attorney's fees and costs in exchange for a voluntary resignation and general release <br />of employer liability including but not limited to an ADA release; a stipulation that his <br />subsequent April 30, 2001 claim is not compensable; that another condition is unrelated to his <br />August 25, 1998, claim, that the County has no lien on his April 30, 2001 accident or subsequent <br />treatment; and that his April 3, 1998, and April 23, 1996 claims are included with this settlement <br />ON MOTION by Commissioner Adams, SECONDED BY <br />Commissioner Macht, the Board unanimously approved a <br />settlement with Henry Beidler in the amount of $75,000 <br />including attorney fees and costs in exchange for a voluntary <br />resignation and general release of employer liability, including <br />but not limited to an ADA release; a stipulation that his <br />subsequent April 30, 2001 claim is not compensable; that <br />another condition is unrelated to his August 25, 1998 claim; that <br />May 14, 2002 <br />16 <br />DV <br />
