ALTERNATIVES AND ANALYSIS <br /> There are three property owners including one unified group of <br /> property owners involved as follows : <br /> 1 . Delta Farms Water Control District ( Premium Citrus , Inc . & Citrus <br /> from Indian River , Inc . ) <br /> 2 . Alexander ( Lex ) Kromhaut <br /> 3 . James B . Cain <br /> The Delta Farms owners , represented by Talmage Rogers , has met with <br /> DOT and County staff . The DOT is not willing to pay damages of <br /> $ 80 , 580 ( see 03 - 26 - 01 letter from Talmage Rogers attached ) . <br /> Alexander Kromhaut has listed several issues that have not been <br /> resolved included damages totaling $ 96 ; 16 . 40 , loss of citrus <br /> trees , business damages , etc . A final figure has not been <br /> determined . <br /> James B . Cain , represented by Attorney Bill Caldwell , has presented <br /> a list of unresolved damages and expert fees totaling $ 85 , 900 . <br /> The alternatives are as follows : <br /> Alternative No . 1 <br /> To resolve the right - of - way acquisition and move the <br /> project along , a cost of $ 263 , 096 . 40 may settle most <br /> issues with the property owners along 4 - 5 miles of SR60 <br /> right - of - way . Mr . Kromhaut appears to be the only <br /> property owner with undefined settlement costs . The <br /> County could agree to pay the above costs , thereby <br /> avoiding eminent domain and future delay . At a later <br /> date , the County could request reimbursement by the DOT . <br /> Alternative No . 2 <br /> The DOT has begun the eminent domain process . An order <br /> of taking hearing is being scheduled with the courts <br /> soon . DOT and property owners are meeting to settle the <br /> issues , but it appears that the above issues are not <br /> being agreed upon . The County could simply take no <br /> action , and allow the eminent domain process to take its <br /> course . Once the Order - of - Take has been approved , there <br /> should be no further project delays unless the decision <br /> is appealed . <br /> RECOMMENDATIONS AND FUNDING <br /> If the County wants to minimize further potential delay , <br /> Alternative No . 1 is recommended . Funding would be from Fund 109 <br /> . Local Option Gas Tax . It is possible that Alternative No . 2 <br /> would result in no future delay if the order - of - take is not <br /> appealed , since title is vested in DOT once the judge issues the <br /> order . <br /> MAY 159 2001 <br /> K <br /> Ers <br /> - 74 - <br />
