DESCRIPTIO \ A1DCOYDITIO 'vS <br /> The proposed acquisition consists of two tax parcels in the Oyster Bar Salt Marsh proiect . The Walker <br /> propeis one of two ownerships in the "gap " between the Simmons and Andre parcels trial m at <br />were acquired <br /> by the County earlier this vear . The Walker purchase would bnng the total area of acquired lands to —96 <br /> acres . The overall project was approved in 1998 as a Flonda Communities Trust ( FCT ) 5W50 cost -share <br /> project . <br /> Ovster Bar Salt Marsh was added to the LAAC acquisition list in 1997 . The project is ranked 5th out of 14 <br /> sites on the 2001 LAAC acquisition list . County bond funds are available for the purchase under the first <br /> series S15 million bond issuance . <br /> In its application for state cost- share funding, the County chose to be the lead agency for pre-acquisition <br /> tasks and negotiations . Dunne the past year, the county's acquisition consultant, in coordination with count% <br /> staff. has conducted pre-acquisition tasks and negotiations . Since the seller recently accepted and executed <br /> a purchase contract Option Agreement, appraisal results and other confidential information can now be <br /> released . <br /> Confidentiality * 4dverticed P ffilic M etino <br /> Procedures adopted by the Board of County Commissioners for environmental land acquisition include <br /> confidentiality of appraisals . In accordance with the County's Land Acquisition Guide , and Section 125 . 355 <br /> of the Florida Statutes . appraisals can be released for public information once an option agreement is <br /> executed between a seller and the County . Regarding the Walker parcels . an option agreement has been <br /> executed (binding the seller to a negotiated purchase price) , and subsequently the appraisals were released <br /> from confidentiality . <br /> When a county exercises its confidentiality right in purchasing real property . Section 125 . 355 , F . S . requires <br /> that the county approve the purchase at a public meeting not less than 30 days after appraisals are released <br /> and public notice of the meeting is given . Since the Chairman of the Board of County Commissioners , <br /> pursuant to authonty delegated by the Board, executed a purchase option for the Walker parcels . and since <br /> appraisals of the parcels were made public at that time , the Board must now consider whether to exercise <br /> its purchase option . Consistent with Chapter 125 , F. S . requirements , this decision will be made at the June <br /> 12 , 2001 public meeting of the Board of County Commissioners . By having given 30 days public notice of <br /> this proposed action, the County will have complied with Chapter 125 requirements as well as L.AC Guide <br /> requirements to hold a public hearing before purchasing property with land acquisition bond funds . <br /> LAAC Recommendltian <br /> The County Land Acquisition Advisory Committee , at its meeting on May 30 , 2001 . voted unanimously to <br /> recommend that the Board approve the purchase contract . <br /> Site Charnctericticc <br /> The parcels natural areas include impounded salt marsh i = 4 . 3 acres ) and tropical maritime hammock with <br /> some Brazilian pepper disturbance ( - 0 . 65 upland acres ) . The parcels have - 60 feet of road frontage on SR <br /> AIA . The upland portion of the propem is zoned RS - 3 . Single - Family Residential . up to 3 units per acre . <br /> The wetlands portion of the propem is zoned Con - 2 .
