<br /> A public hearing has been scheduled for the Board of Countv Commissioners to be held on
<br /> Tuesdav , July 3 , 2001 . The purpose of the public hearing shall be for public input and the
<br /> board ' s consideration of an ordinance authorized by the Communications Service Tay
<br /> Legislation . To be considered would be the establishment of additional rates in lieu of nsht -of-
<br /> wav fees and to authorize Indian River County to increase the rate on the Communications
<br /> Service Tax .

<br /> BACKGROUND :
<br /> On June 6 . 2001 , the Board of County Commissioners awarded to Chilberg Construction Companv, Inc .,
<br /> the bid for the improvements to the North County Library . Chilberg Construction was the lowest
<br /> complying bidder and had bid a price of $ 1 .244 , 763 for the work as requested within the bid documents .
<br /> The contractor has included as part of his bid a time period of 300 days to complete the work .
<br /> I have attached a document entitled "Standard Form of Agreement Between Owner and Contractor where
<br /> the basis of payment is a Stipulated Sum, " AIA Document A101 - 1997 , 1997 Edition . This particular
<br /> document has the recommended modification as recommended by the National Construction Law Center .
<br /> Inc . The recommendations were also included into the documents prepared by the architect and approved
<br /> by the County Attorney ' s office . Specifically, AIA Document P.201 - 1997 , as modified with
<br /> recommendations of the Construction Law Center. Inc . , is part of this agreement as referenced within the
<br /> agreement and as part of the Project Manual prepared by Edlund and Dntenbas , Architects, P . A . . , dated
<br /> March 9 , 2001 , which was advertised as a bid specification document that the contractor would have to
<br /> use as part of the contract document .
