Collins II — Deputy County Attorney <br /> DATE : June 11 , 2001 <br /> SUBJECT : Authorization to Amend Indian River County Code Section 103 . 03 , <br /> Regulatory Commissions and Boards <br /> Indian River County Code Section 103 . 03 (3 ) , creating the Building Code Board of <br /> Adjustment and Appeals requires that one member of that board be a <br /> representative of the Board of Zoning Adjustment . Since the Building Code <br /> Board of Adjustment and Appeals and the Board of Zoning Adjustment are <br /> regulatory boards with final decision making authority , such a requirement is in <br /> conflict with Article II , Section 5 of the Florida Constitution ' s prohibition on dual <br /> office holding . <br /> REQUESTED ACTION : <br /> Authorize staff to proceed with advertising for a public hearing to be held on July <br /> 17 , 2001 to consider amending Section 103 . 03 (3 ) of the Indian River County <br /> Code to delete the requirement that a member of the Building Code Board of <br /> Adjustment and Appeals be a representative of the Board of Zoning Adjustment . <br /> JUNE 199 2001 <br /> - 101 - <br />
