There is a significant difference in the rate structure and channel line-up in North and South <br /> County . This situation will not likely go away immediately and may continue to be a source of <br /> customer dissatisfaction in the North County . While this would be a good time for AT&T <br /> Broadband to start toward rate panty, demanding such a move as a condition for the approval of <br /> the transfer does not appear to Staff to be legitimate under current law. <br /> RECOMMENDATION <br /> Staff recommends that the Board of County Commissioners approve the attached resolution <br /> subject to the terms of the agreement between AT&T Broadband and Charter Communications <br /> as presented in the Form 394 submitted with the request for transfer, and subject to AT&T <br /> Broadband ' s commitment to meet all conditions of existing County ordinances governing the <br /> provision of Cable Television Service in Indian River County . <br /> General Services Director Tom Frame reviewed the project for the Board and noted <br /> that representatives are here from Charter and from AT&T . <br /> Telecommunications Manager Terry Smith explained that AT&T could have <br /> expanded to the North County area without any approval necessary . The rates and channel <br /> lineups for the North County area are not the same as for our area and the requirements are <br /> different for North County and Brevard County . The channel lineups are not subject to local <br /> jurisdiction . The approval of the transfer cannot be unreasonably withheld . Staff is <br /> recommending approval .
