petition paving project approved for 31" Avenue S.W., since Ansley Park residents would <br />not benefit from the paving of 31S` Avenue S.W. and therefore would not be required to <br />pay for a share of the 3151 Avenue S.W. paving. <br />• Sidewalks: The previously described internal project sidewalks will be located within <br />private right-of-way and common areas and will be owned and maintained by a private <br />property owners association. In addition, a 5 wide public sidewalk will be built or <br />bonded for along the site's 13`h Street S.W. frontage prior to issuance of a certificate of <br />completion. <br />• Street Lights. Streetlights will be provided at all street entrances, intersections, and <br />curves and will be owned and maintained by a private property owners association. <br />• Stormwater and Recreation Tracts: Stormwater tracts, easements, and recreation tracts <br />will be the responsibility of a private property owners association. <br />• Murphy Act Easement: There is a Murphy Act Easement which covers a portion of the <br />site's north end, adjacent to 9th Street S.W. (Oslo Road) Since the County does not <br />want to acquire any9`h Street S.W. (Oslo Road) right-of-way from the site, Public Works <br />supports release of the Murphy Act Easement for this site. Because the Murphy Act <br />Easement covers an area proposed for green space, the easement will need to be released <br />prior to issuance of an LDP. <br />13. Environmental Issues: <br />• Wetlands: The site contains 4.96 acres ofjurisdictional wetlands, the majority of which <br />are located in the southeast comer of the project. The applicant is proposing to impact <br />(fill) two of the site's small isolated wetlands totaling 0.68 acres and mitigate that impact <br />on-site by placing conservation easements over the larger 3.83 acre wetland located in the <br />southeast corner of the site and a small isolated wetland located along the site's west <br />border. The conservation easements will need to be established prior to or via the final <br />plat. In addition, the applicant will need to obtain all junsdictional pennits for the <br />wetlands mitigation prior to issuance of an LDP Required mitigation must be completed <br />prior to issuance of a certificate of completion. <br />Native Upland Setaside• Since the site is over 5 acres and contains native uplands, the <br />native upland setaside regulations apply to this site. The majority of the site (33.68 out of <br />48.12 acres) is native upland habitat. To satisfy the 5.05 acre (15%) setaside requirement <br />the applicant proposes to establish 5.53 acres (16.41%) of uplands conservation <br />easements over various tracts within the project. <br />Since many of the proposed upland tracts are 30' deep and are adjacent to rear yards, <br />environmental planning staff is requiring that a fence or other barrier be placed between <br />the lots and the conservation tract during construction of the subdivision improvements. <br />The fence or barrier design will need to be approved prior to issuance of an LDP. <br />• Tree Preservation: On the site, there are a number of protected and "specimen" trees <br />which the applicant is working to save All protected and specimen trees within the <br />proposed buffer and preservation areas are to be preserved. Some of the waiver requests <br />are designed to save trees on individual lots. In an effort to preserve trees, the applicant is <br />proposing to micro -site individual homes on lots and has provided a tree survey exhibit <br />which details which lots have protected oak trees and will be subject to special tree <br />preservation efforts This exhibit will be used through the subdivision and single family <br />home review and construction processes to ensure that trees are preserved on those <br />specific lots. <br />JULY 16, 2002 <br />-34- <br />
