enforcement penalties in the event of a violation of <br />easement conditions; and (2) obtain, prior to <br />construction, an intensive cultural resource <br />assessment survey (up to and including a "Phase III" <br />assessment, if warranted by findings) of the <br />archaeological area west of Indian River Drive that <br />will be disturbed and inaccessible in the future; and <br />(3) overlay on the site development plan, prior to <br />construction, the location of the archaeological shell <br />midden and coordinate with county environmental <br />planning staff to "field -adjust" development design <br />to protect "extraordinary significant resources" as <br />warranted. "Extiaordinary significant resources" <br />refers to archaeological resources of such <br />significance that preservation (vs. excavation and <br />study) is warranted, as determined by a certified <br />archaeologist with concurrence from the State <br />Historic Preservation Officer (SHPO). If <br />"cxtraoidiirary significant resources" are found and <br />cannot be protected via field adjustment of project <br />design under the current site plan, then the project <br />shall be subject to further HRAC review and <br />recommendations prior to construction; as <br />recommended by staff and as corrected by the <br />Board. <br />
