Chairman Ginn advised she had a problem with Han-Padron because she has learned <br />that the% had not filed to re -register with the State. <br />Deputy County Attorney Will Collins had raised the concern that thev were not <br />registered in Florida and that. when contacted, they did make a filing. He thought they were <br />dillo.entiv trving to get reestablished to transact business in Florida as they vere a few nears <br />ago. He was concerned. but there is a provision in the corporations law that says that the <br />failure to register does not impair the validity of their contracts. He believed that this <br />shoreline stabilization project is going to be funded to some extent through the FIND <br />program and wanted to make sure not to go beyond that cycle. It is true they have not yet <br />gotten their paperwork squared away with the State. <br />Chairman Ginn still had a problem with dealing with companies like this. <br />Public Works Director James W. Davis advised that the selection committee had <br />ranked Han-Padron number one under CCNA guidelines. <br />Commissioner Adams recalled that the Board had in the past awarded the bid to a <br />local second bidder particularly if the dollar amount was close. <br />There was discussion about awarding the bid to the second ranked company, which <br />is local, and eliminating the first ranked company. <br />Director Davis advised that if the Board decided to do that, then staff would negotiate <br />a contract with the second ranked company but could not go back to the number one. <br />MOTION WAS MADE by Vice Chairman Stanbridge, <br />SECONDED by Commissioner Tippin, to negotiate with the 42 <br />ranked firm.
