Keating, AICP <br />Community Development Direct// <br />Stan Boling, AICP <br />Planning Director <br />August 2, 2002 <br />GHA Grand Harbor Ltd.'s Request For a Change to the Grand Harbor DRI <br />Development Order <br />It is requested that the data herein presented be given foicual consideration by the Board of County <br />Commissioners at its regular meeting of August 13, 2002. <br />DESCRIPTION & CONDITIONS: <br />On October 23, 1985, the Board of County Commissioners adopted a development order (D.O.) <br />approving the development of regional impact (DRI) known as Grand Harbor. Over the last 17 <br />years, twelve amendments were approved that modified the original D O. The amended D.O. <br />remains in effect and governs the general development of the entire project via specific D.O. <br />conditions and approved application materials that include a project master plan (land use) map. <br />Much of the project is complete or under construction, although less than one half of the total <br />number of DRI -approved residential units have been built. To date, Grand Harbor has built well <br />below its maximum density, and staff anticipates that Grand Harbor will build out substantially less <br />than its maximum permitted density. <br />GHA Grand Harbor Ltd., the developer of the Grand Harbor DM (Development of Regional Impact) <br />project, has filed a Notice of Proposed Change (NOPC) to amend the project Development Order <br />(see attachment #2). The proposed change principally involves adding ` The Reserve" site (a portion <br />of the former Whisper Lakes Golf Course: see attachment #1) to the overall Grand Harbor <br />development along with some changes to the Indian River Boulevard/53`d Street intersection (see <br />attachment #3). The proposed changes have been reviewed by county staff, the state (DCA and <br />FDOT), and the Regional Planning Council (TCRPC). The applicant has addressed comments from <br />all reviewing agencies and county staff (see attac inrent #51. <br />Pursuant to FS 380.06, which governs DRIs, the county may determine that the request does not <br />constitute a substantial deviation. It should be noted that, in staffs opinion the request does not <br />constitute a substantial deviation. If such a determination is made by the Board of County <br />Commissioners, then the request will be treated as a proposed change or "minor amendment". As a <br />minor amendment, a change in an approved D.O. can be made by the Board of County <br />Commissioners without a formal vote and recommendation from the Regional Planning Council. <br />August 13, 2002 <br />28 <br />
