• <br />Pursuant to County LDR section 916.05(1), the Planning and Zoning Commission considered this <br />request. At its July 25, 2002 meeting the Planning and Zoning Commission voted 6-0 to <br />recommend that the Board determine that the request does not constitute a substantial deviation and <br />approve the request by adopting the attached resolution (see attachments #4 & 6). <br />ANALYSIS: <br />Grand Harbor's request proposes to add "The Reserve" site to the overall Grand Harbor <br />development. County staff and reviewing agencies have verified that there are no environmentally <br />sensitive areas on the site and that no adverse environmental impacts are anticipated as a result of <br />developing the site as proposed. The 77.8 acre site, located on the north side of 53r1 Street <br />immediately west of Grand Harbor's River Club golf course, is being added without increasing the <br />total number of units already approved for the existing Grand Harbor development. If approved, the <br />proposed change will allow up to 130 units on "The Reserve' site and will decrease the total <br />maximum number of units allowed within the portion of Grand Harbor located east of Indian River <br />Boulevard by 130 units. Because the total number of overall units will not change, and because the <br />overall total project area will increase (from + 870 acres to + 948 acres), the overall project density <br />will actually decrease. <br />The NOPC also conceptually depicts a change to the 53`d Street/Indian River Boulevard intersection, <br />whereby access into "The Reserve" and to the River Club and harbor areas to the east will be via a <br />new private roadway segment that will connect to the 53rd Street/Indian River Boulevard <br />intersection. While these changes will be reviewed in detail by county staff during the development <br />review process for "The Reserve", county staff has worked with the applicant to include in the D.O. <br />a condition relating to 53`d Street right-of-way dedication, 53`d Street changes, and 53`° Street/Indian <br />River Boulevard intersection changes. Because those changes will result solely from the applicant's <br />development project, the recommended D.O. condition states that the developer will dedicate 53`d <br />Street right-of-way and pay all costs relating to changes to 53`d Street and the 53`d Street/Indian River <br />Boulevard intersection. The condition includes monitoring of the intersection for traffic control (e.g. <br />signal) warrants and requires the developer to pay for any traffic control devices required. This <br />condition is contained in proposed D.O. condition 53(b), which is incorporated into the proposed <br />approving resolution [see attachment #6]. <br />With this condition, staff is satisfied that all applicable right-of-way and traffic issues are adequately <br />addressed within the D.O. Subsequent to approval of the D.O. changes, details regarding ri ght-of- <br />way dedication, traffic design, and traffic control devices will be finalized through the county's <br />development review process. <br />• Determination: Not a Substantial Deviation Request <br />As previously stated, no increase in the total number of units for the overall project is <br />proposed and no adverse environmental impacts are anticipated as a result of the proposed <br />change. In addition, the proposed change contains a condition that adequately addresses <br />right-of-way and traffic issues associated with the proposed change. <br />No part of the proposed D.O. change constitutes a substantial deviation as set forth in FS <br />380 06. Thus, the request should be considered to not constitute a substantial deviation. <br />• Effects of the Amendment <br />If adopted, the proposed amendment would add "The Reserve" site to the overall Grand <br />Harbor D.R I. project area and allow for traffic changes to the area around the 53rd <br />Street/Indian River Boulevard intersection, subject to condition 53(b) as previously <br />described. Adoption of the D.O. amendment will allow the developer to go through the <br />county's development review process for development of ' The Reserve" site. <br />August 13, 2002 <br />29 <br />
