RESOLUTION NO. 2002- 059 <br />WHEREAS, the project developer (GHA Grand Harbor, Ltd.) has faunally applied for and has <br />agreed to certain changes to the development order; and <br />WHEREAS, the proposed changes include: adding the + 77.8 acre ' The Reserve" residential site to <br />the overall project without increasing the total number of allowable units and allowing for traffic <br />changes to the area around the intersection of 53`d Street and Indian River Boulevard; <br />NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Indian River <br />County, Florida that: <br />1 The Board of County Commissioners finds that the proposed changes to the development <br />approval do not constitute a substantial deviation pursuant to Chapter 380.06 of the Florida <br />Statutes. <br />2. The Notification of Proposed Change To A Previously Approved Development of Regional <br />hnpact (DRI) application and materials submitted by the developer GHA Grand Harbor. Ltd <br />dated May 17, 2002, along with subsequent and related staff and applicant correspondence <br />and all other related materials are hereby incorporated by reference into the Application for <br />Development Approval (ADA) for the project <br />All conditions and restrictions specified in the project development order (Resolution 85- <br />128), and all subsequent amendments (reference the resolutions referenced above) shall <br />remain in full force and effect on the entire project area, except as modified by the <br />development order changes contained in this resolution. <br />The project development order language is amended as follows: <br />A. Exhibit "A'', the legal description of the Grand Harbor Development of Regional <br />Impact, as adopted by Resolution 85-128, and amended by subsequent resolutions amending <br />the Grand Harbor DRI Development Order, containing the legal description of the Grand <br />Harbor DIU, is hereby further amended by Exhibit A " to this Resolution, attached hereto <br />and incorporated herein, which Exhibit "A" shall become Exhibit "A" to the development <br />order. <br />B. Exhibit "I3", The ,FfasterDevelopment Plan, as originally adopted by Resolution 93- <br />88, and amended by Exhibit "A" to Resolution 98.01, is hereby further amended by Exhibit <br />"B" to this Resolution, attached hereto and incorporated herein, which Exhibit "B" shall <br />become Exhibit 'B" to the Development Order. <br />C. Exhibit "C", The Land Use and Phasing Plan, as originally adopted by Resolution <br />93-88, and arnended by Exhibit "B " to Resolutions 98-01 and 2001-085, is hereby further <br />amended by Exhibit "C" to this Resolution, attached hereto and incorporated herein, which <br />Exhibit "C" shall become Exhibit "C" to the Development Order. <br />D.
