to deny <br />d <br />north of C.R.1510apply <br />to any segment of Old Dixie, including the subject segment <br />• Summary <br />If approved, the proposed abandonment would eliminate historical public road right- <br />of-way, would remove a convenient southbound bypass to the U.S. 1/C.R. 510 <br />intersection, and would alter secondary access to the rear of the property owned by <br />the Fenders. The Fenders object to such changes. To address concerns that Public <br />Works and Traffic Engmeenng have about the impacts of granting <br />the request, the <br />applicant proposes a right-of-way swap and physical traffic improvements. Because <br />the Board cannot place conditions on any abandonment action (it can only reserve <br />rights it already has such as retaining easements over the existing right-of-way), the <br />swap and improvements cannot be guaranteed as mitigation for the abandonment <br />action unless such actions are covered under a yet -to -be prepared contract For these <br />reasons, planning staff cannot support the request. <br />If the Board wishes to approve the abandonment and guarantee that certain conditions <br />will be met then the Board would need to indicate that it supports <br />defer action until a contract executed by the applicant is a aable,ea d direct the <br />County's Attorney's Office to prepare a contract agreement that provides guarantees <br />for the right-of-way swap and traffic improvement items. Thus, the formal <br />abandonment decision would need to be postponed to a time when the `contract' <br />issues have already been addressed. <br />In the event that the Board decides to approve the abandonment request without any <br />contract arrangement, a resolution which has been approved by the Attorneys Office <br />is attached. That resolution, if adopted, would abandon the subject segment Old <br />Dixie Highway and retain a drainage and utility easement on the right-of-way area Old <br />requested by the utility providers and reviewing departments. as <br />RECOMMENDATION: <br />Based on the analysis, staff recommends that the Board of County Cornjssioners deny <br />the request to abandon its rights to the subject right-of-way. <br />ATTACIIVIENTS: <br />1.
