• <br />Planning Director Stan Boling reviewed the Memorandum for the Board and, in response <br />to questioning, stated that there is no existing sidewalk along 4`h Place and it is required. <br />However, the Board could waive that sidewalk as it is an industrial area where pedestrian traffic <br />is not expected. <br />The Chairman opened the public hearing and asked if anyone wished to be heard <br />regarding this matter. <br />Brian Heady felt there would be no reason to eliminate the sidewalk. <br />The Chairman asked if anyone else wished to be heard regarding this matter. There being <br />none, the Chairman closed the public hearing. <br />AUGUST 6, 2002 <br />ON MOTION by Commissioner Tippin, <br />SECONDED by Commissioner Ginn, the Board <br />unanimously found that: (1) it is empowered under <br />the provisions of Chapter 971 to review the special <br />exception applied for; (2) the granting of the special <br />exception will not adversely affect the public <br />interest; (3) the application satisfies the general and <br />specific criteria required for special exception <br />approval; and (4) the conditions stated below are <br />adequate to ensure compatibility between the <br />special exception use and surrounding land uses; <br />and unanimously granted special exception use <br />approval for the proposed residential treatment <br />center expansion with the conditions that prior to <br />issuance of a certificate of occupancy for the new <br />85 <br />,a U5 <br />• <br />
