7.U. ROSELAND ROAD SIDEWALK IMPROVEMENTS - RIGHT-OF-WAY <br />ACQUISITION - PETER J. MCGRATH <br />The Board reviewed a Memorandum of July 24, 2001: <br />TO: James E. Chandler, County Administrator <br />THROUGH: <br />FROM: <br />James W. Davis. P.E.. Public Works Director. <br />AND <br />Christopher J. Kafer, Jr.. P.E., County Engine <br />Ronald L. Callahan, SRA, Right -of -Way Agent <br />SUBJECT: Right -of -Way Acquisition <br />Roseland Road Sidewalk Improvements <br />Peter J. McGrath <br />DATE: July 24, 2001 <br />CONSENT .AGENDA <br />DESCRIPTIONS AND CONDITIONS <br />An additional 20 feet (20') of right-of-way is needed along the south side of Roseland Road at <br />I2720 Roseland Road, Sebastian Florida to accommodate a sidewalk project extending from <br />126th Street to the Riverwalk Plaza in Sebastian, Florida. The owner has executed a contract at a <br />negotiated price of $7,000.00, which is limited to land only. There are other terms and <br />conditions as reflected in the attached addendum to the contract. In addition, the property owner <br />has agreed to grant to County a 10 -foot (10') Temporary Construction Easement. Such easement <br />shall remain in affect until work is completed at the subject location. <br />The contract price is $7,000 00. The subject right-of-way parcel measures 20 feet by 300 feet, <br />which is 6,000 square feet. The purchase price for the land is $7,000.00 based on 6,000 square <br />feet at S1.1667 per square foot This price per square foot is slightly higher than that paid to other <br />property owners affected by this project along Roseland Road We had been paying $1.00 per <br />square foot. This price per square foot was achieved after a protracted period of negotiation. <br />Initially, the owner had wanted $2.00 per square foot and we were offering $0.75 per square foot. <br />In addition, the owner has been consistently concerned about the disposition of one mature oak <br />and several mature Hickory trees located within the 10 -foot Temporary Construction Easement. <br />Based on the road plans, no harm should come to these trees, but to conciliate the property owner <br />and to insure greater care around the trees, Item (c) was inserted into the addendum to cover this <br />contingency. The contractor will be advised of this condition. There are no appraisal or attorneys <br />fees. Other terms and conditions in the contract are delineated in the attached addendum to the <br />contract <br />ALTERNATIVES AND ANALYSIS <br />1.
