COPIES OF SATISFACTION OF ESCROW RELEASE CONDITIONS, WAIVER AND <br />ACKNOWLEDGMENT, COLLATERAL DEVELOPMENT AGREEMENT, AND DECLARATION OF <br />EASEMENTS FOR PARKING ARE ALL ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />Chairman Ginn directed County Administrator Chandler to investigate a better sound <br />system and bring back some recommendations within the month. <br />Bond Counsel Robert Reid stated that the documents relative to this project which <br />have been previously approved have been held in escrow pending completion of various <br />conditions imposed on the developer and the Dodgers. All those conditions have now been <br />satisfied and any failure to perform at this point would constitute a breach of contract. The <br />City of Vero Beach has indicated in a written response that the "mini -town" to be developed <br />would be an adjunct to the baseball facility and would fit into the City's zoning. The <br />Declaration of Easements regarding Parking addresses the fact that there is not enough <br />parking on the land being acquired by the County and burdens the developer to provide <br />parking in compliance with the City's parking ordinances should it be required. <br />Chairman Ginn noted that this project has been brought before the public during the <br />August 29, 2000 hearing on the additional Tourist Tax which is part of the funding. There <br />were also meetings on July 24, 2000; September 5, 2000 and September 7, 2000. The <br />Commission has always been willing to hear comments from the public. <br />John Clinton, 3606 Mockingbird Drive, spoke in opposition to the project and <br />believed government should not become involved in private enterprise. He believed that the <br />project does not conform to the regulations of the Constitution of the State of Florida and <br />believed the Board should authorize a referendum vote. <br />AUGUST 7, 2001 <br />-69- <br />BK119PG083 <br />
