Keating, AICP <br /> CommunityDeevelopment irector <br /> ��Af) <br /> FROM : Stan Boling, AICP <br /> Planning Director <br /> DATE : September 4 , 2001 <br /> .SUBJECT : Proposed Change to the HorizowTrime Outlet DRI Development Order <br /> It is requested that the data herein presented be given formal consideration by the Board of <br /> County Commissioners at its regular meeting of September 11 , 2001 . <br /> DESCRIPTION AND CONDITIONS : <br /> On March 24, 1994 , the Planning and Zoning Commission granted major site plan approval for <br /> the Horizon Outlet Center located in the southwest quadrant of the I- 95/S . R. 60 interchange. The <br /> approved site plan proposed 333 , 089 square feet of retail building area on 44 . 11 acres . That <br /> amount of development was determined by the State not to constitute a development of regional <br /> impact (DRI) . Therefore, no DRI review was required for that amount of development. <br /> Subsequently, the project was developed and built-out under the approved site plan. <br /> Later, the project developer proposed a "Phase 2 " expansion of the outlet facility <br />and <br /> construction of other inter-related commercial uses on 138 . 73 acres of adjacent property . The <br /> proposed expansion would more than double the existing commercial building area and <br /> constituted a development of regional impact ( DRI ) . Consequently, the developer applied for <br /> and obtained DRI approval for the expansion. That approval, granted by the Board of County <br /> Commissioners in 1998 . required that construction of the expansion phase (phase 2 ) commence <br /> within 3 years of the DRI approval (2001 ) . The approval included a development order (D . O. ) <br /> which contains several specific traffic conditions that cover required traffic improvements and <br /> monitoring . <br /> To date, no construction has commenced on the expansion phase, although the developer did <br /> obtain site plan approval in 1999 for infrastructure improvements to serve the expansion phase . <br /> That site plan approval has since expired (reference SP-MA- 99-03 - 11 ) . Because construction of <br /> the expansion phase has not commenced, the D .
