McCoy,AICPA <br />Senior Planner, Current Development <br />DATE: August 19, 2002 <br />SUBJECT: McCain & Associates, Inc.'s Request for Extension of Site Plan Approval for <br />Commercial Plaza Known as Sciara Commercial Development <br />(SP -MA -01-10-71/2001030153) <br />It is requested that the data herein presented be given formal consideration by the Board of <br />County Commissioners at its regular meeting of September 3, 2002. <br />DESCRIPTION & CONDITIONS: <br />On September 13, 2001, the Planning and Zoning Commission granted major site plan approval <br />to construct a restaurant and retail complex located on the south side of S.R 60 immediately east <br />of Rex T.V. and backing up to the Main Relief Canal The current expiration date of the site <br />plan approval is September 13, 2002. <br />On July 29, 2002, the project applicant filed a request to extend the site plan approval expiration <br />date. The applicant indicated that the delay in construction is associated with project permitting <br />difficulties. Pursuant to site plan regulations, the extension request may be considered by the <br />Board of County Commissioners because the request was submitted prior to the approval <br />expiration date. <br />ANALYSIS: <br />Although the LDRs have been amended since the time of project review and approval, the <br />members of the Technical Review Committee (TRC) concur that subsequent amendments as <br />applied to the subject project are not significant enough to require substantial revisions or <br />redesign of the project. All TRC staff members have recently approved the applicant's request <br />for site plan extension. <br />As allowed under provisions of the TDRs, the developer is requesting a full one year extension <br />of the site plan approval expiration date. Pursuant to Chapter 914 of the LDRs, the Board of <br />County Commissioners may deny, approve, or approve with additional conditions the requested <br />site plan extension. Staff has no objections to the Board granting the request since the previously <br />approved site plan and corresponding approval conditions substantially confoini to existing LDR <br />requirements. <br />September 3, 2002 <br />28 <br />
