Her property is 200 feet east of the Carlton ' s Lot <br /> 46 and she stated that property had always been a blight on the community because of <br /> neglect . She did not think a 6 - foot stockade fence would change that . She expected the <br /> fence on Lot 7 will be coming up in the future . The covenant and deed restrictions were set <br /> out to protect the aesthetic and property values of the property owners . She stated she had <br /> signatures of people who were out of town who wanted this appeal to be denied . She stated <br /> there are 5 other corner lots which do not have fences . She was concerned about setting a <br /> precedent . Somewhere it is necessary to draw the line . <br /> Ms . Carlton pointed out that she was asking for the fence to be placed 10 feet from <br /> the sidewalk, not on the sidewalk . Second , the president prior to Mr . Thomas did make a <br /> statement at an annual meeting that the street could be used for overflow parking . As to the cars parked along <br /> the right- of-way , they were not parked illegally or outside their covenant or by- laws . <br /> Chairman Ginn asked if anyone else wished to be heard . Although this was not a <br /> public hearing, she stated the Board would hear anyone who wished to be heard . <br /> Commissioner Macht thought the Association had abrogated their rights to deed <br /> September 4 , 2001 <br /> 56 !� <br /> PFG 3 4 <br />
