RECOMMENDATION : <br /> It is the staff recommendation that the Board proceed by taking the following action : <br /> 1 . Approve the Grant Award Agreement and Addendum and authorize the Chairman to execute <br /> both documents ; <br /> 2 . Authorize the Chairman to sign the four individual Advanced Payment Requests <br /> 3 . Authorize the Chairman to Execute the Restrictive Covenants as Grant Recipient with, <br /> an attached legal description identified as "Exhibit A" which is to be identical to the <br /> modified legal description for the Interlocal Agreement between Indian River County <br /> and the City of Fellsmere . (The Chairman ' s signature shall not be authorized until <br /> both the County and Fellsmere approve such modified legal description. <br /> 4 . Staff be authorized to send all locally executed documents to the Department of State <br /> as requested by that agency . <br /> Vice Chairman Stanbridge had a question on page 216 (a map ) which says <br /> " conceptual plans " which has not been approved . She assumed this map was being used for <br /> some other purpose . <br /> General Services Director Thomas W . Frame explained the purpose of this page was <br /> to merely show the City buildings located in that block . When the initial legal description <br /> was placed into the agreement between the City of Fellsmere and the County , they included <br /> the legal description of the entire block . John Little of Fellsmere called him last week and <br /> said he " didn ' t want to pay rent . " He noted that the alley between the two rows of lots is an <br /> important element because it abuts the old School Building and we will have some <br /> improvements within that particular area . The alley was not owned by the City , but it was <br /> owned by the Fellsmere Water Control District and they have agreed to transfer title to the <br /> City . A forthcoming new legal description should be able to straighten all that out . <br /> Vice Chairman Stanbridge wanted to make sure that page did not accompany the grant <br /> agreement to Tallahassee , and Director Frame assured her it would not, that it was for <br /> illustrative purposes only . <br /> Chairman Ginn understood that until the legal description has been modified it will <br /> not be presented for signature , and Director Frame assured her she was correct . <br /> September 4 , 2001 <br /> 72 r, <br /> PG 350 <br />
