Tillis <br /> DATE : August 28 , 2001 <br /> DESCRIPTION AND CONDIIIONS <br /> In April of 2000 , after Board approval , the County purchased thirty feet of right-of-way from <br /> the owners . The Indian River Farms 1920 map showed the existence of a thirty foot road <br /> right-of-way ; and the purchase of thirty additional feet would have provided a total of sixty <br /> feet necessary for the project. <br /> Recent findings show that there was apparently never a recorded conveyance of the right- <br /> of-way shown on the Indian River Farms map . This case is similar to the situation that <br /> occurred with the Turner acquisition in July of 2001 . The Turner property is adjacent to <br /> Tillis . The Tillises have now asked that the County pay them for the east thirty feet , which <br /> lies between the canal right-of-way, and the thirty feet parcel purchased by the County last <br /> year. <br /> The owners have executed a contract at a price of $ 1 . 00 per square foot for the A- 1 zoned <br /> ( M- 1 Land Use designation ) land . $ 1 . 00 per square foot is the same price the County paid <br /> Tillis previously , and the same price paid to other owners along this section of 74' Avenue . <br /> The Contract Price is $ 9 , 981 . 00 . There are no appraisal or attorney fees ; however, the <br /> Tillises have added to the contract, the condition that the County agrees to pay the County <br /> Water Impact Fee at such time as Sellers hook up . This was also a condition of the Turner <br /> acquisition . The current Water Impact Fee is $ 1 , 300 . 00 . <br /> RECOMMENDATIONS AND FUNDING <br /> Staff recommends the Board of county Commissioners approve the $ 9 , 981 . 00 right-of-way <br /> purchase , and future payment of the Water Impact Fee for 1 ERU ( currently $ 1 , 300 . 00 ) , <br /> and authorize the Chairman to execute the contract .
