!� WHEREAS, said C. Reed Knight and Mary Betty Knight have further shown that <br />the vacation by the Board of Couaty Commissioners of the part of said subdivision sought to <br />be vacated will not affect the ownership of persons owning other parts of said subdivision, <br />and <br />WHEREAS, they have shown that no conveyance has ever been made of record <br />using said plat as a reference, but rather that all conveyances of said property have used <br />only a description with reference to acreage or a metes and bounds description, and that said <br />property has always appeared on the tax and assessment rolls only as acreage, and <br />WHEREAS, the County Commissioners upon proof duly shown have found that there <br />is not now nor ever has been any use made of said subdivision by the public, and <br />said Board of County Commissioners have found that there are no <br />streets or alleys that have become necessary, for use by.the traveling public, and that all <br />streets, avenues, boulevards, alleys and public rights -of -wag whown on the plat have never <br />been opened up and used by the public, and that the park dedicated on said plat has never <br />been used as a park by the public, and <br />ii <br />WHEREAS, said Board of County Commissioners do find that said property is not <br />located in any incorporated city or town and that it is for the.best interests of the public <br />and the owners of said property that said plat or subdivision be vacated for the purpose of <br />returning said property into acreage for taxation, and <br />WHEREAS, said Board of County Commissioners do further find that newspaper <br />notice as required by law was given and that Proof of Publication as required.by law was <br />given and that Proof of Publication as required by, law was filed this day with the Board of <br />County Commissioners, <br />NOW, THEREFORE, BE IT RESOLVED that that portion of "Penn Park", a subdivision'; <br />recorded in Plat Book 2, page 2, public records of Indian River County, Florida, described as <br />follows, to -wit: <br />All of the plat of "Penn Park" a subdivision recorded in <br />Plat book 2, page 29 public records of Indian River <br />County, Florida, Except that part of said subdivision <br />lying in and indluding the E 10 Acres of NE's of S?^1�, <br />Section 139 Township 33 South, Range 39 East and also <br />that part of said subi.ivision lying East of the East <br />boundary line of the SW4, of Section 13, Township 33 <br />South, Range 39 East; - <br />be and the same is hereby vacated, abolished, and abandoned. <br />Upon being duly seconded by Commissioner Waddell, the same was unanimously <br />adopted. <br />Pursuant to certified copy of Resolution #621, passed by the Vero Beach City <br />Council at their regular meeting held on February 17, 1953, the Board adopted the following <br />'Resolution. <br />c <br />RESOLUTION REVOKING DEDICATION OF WEST -ONE-HALF OF LOT 22, BLOCS 27, <br />ROTA.L PARK SUBDIVISION <br />Commissioner Waddell introduced the following Resolution and moved its <br />adoption, to -wit: <br />i <br />R E S O L U T I O N <br />WHEREAS, by Resolution heretofore adopted by the City Council of the City of <br />i <br />0 <br />1 <br />n <br />1 <br />1 <br />
