• <br />• <br />PROPOSED CHANGES - PURCHASING MANUAL <br />F. Executed Contract. The Originating Department shall be responsible for returning a <br />fully executed original contract to the vendor and shall prepare and send a notice to proceed to <br />the contractor when appropriate. <br />G . Forfeiting of Bonds. <br />Default by Contractor. All contracts for construction services shall contain a clause <br />providing for termination upon default of the contractor and providing that in such cases the <br />surety company shall bear responsibility for the completion of the contract, or if no surety <br />company has provided a performance bond, the County may claim the alternative security and use <br />such funds for the completion of the contract. <br />H . Termination for Convenience. All construction contracts shall contain clauses <br />providing for the termination of the contract for convenience of the County, and shall prescribe <br />methods by which the contractor may calculate the cost of work already performed and <br />termination settlement costs. <br />I. Indemnification. All construction contracts shall provide that the contractor (or <br />o ther appropriate party) shall indemnify and hold harmless the County and its officers and <br />e mployees, from liabilities, damages, losses and costs, including, but not limited to, reasonable. <br />attorney's fees, to the extent caused by the negligence, recklessness, or intentional wrongful <br />misconduct of the contractor (or other appropriate party) and persons employed or utilized by the <br />contractor (or other appropriate party) in the performance of the construction contract. <br />4.5 CHANGE ORDERS <br />A. Applicability. Modifications may be made to an executed contract, which do not <br />substantial] alter the character of the work contracted and which do not vary substantially from <br />the ori_inal s•ecifications as to constitute a new undertakin•. Such chan es must be reasonabl <br />✓ iewed as bein <br />in fulfillment of the ori:inal sco•e of the contract and must be clear) directed to <br />the achievement of a more satisfactory result or to the elimination of work not necessary. <br />B. Purchasin- Mana•er Authorit . The Purchasin: Mana:er is authorized to a.. rove <br />chane orders to contracts executed under the Purchasin <br />Mana_er s authorit <br />rovided the <br />criteria in paragraph A above are met and the total value of the contract does not exceed <br />525,000. <br />C. Count Administrator Authorit . The Count Administrator is authorized to a.. rove <br />and authorize chan <br />e orders wh.ch fit the criteria in <br />ara:ra.h A above where the net <br />modificafon in the contract amount does not exceed 55,000, unless contract was 'nitially awarded <br />solel under the Purchasin: Mana:er or Count Administrator s authorit 50 000 threshold and <br />the total value of the contract still does not exceed 550,000. <br />D .
